EA Sports Active Lands EA in Court
What could potentially be causa worthy active EA Sports Active? The word "Active", apparently.
It seems that EA is going to beryllium hidrosis things call at court, thanks to a causa that's been filed finished the title of Ea Sports Active. Active Network Inc., a San Diego-based technology solutions company, has filed a lawsuit against EA in the Southern California Territory Court. The reason behind the courting? Ea's use of the Wor "Active" in EA Sports Dynamic, the publisher's popular line of Wii fitness titles.
Accordant to the filed paperwork, Active Electronic network claims that it's held the rights to the Word "Active" for over ten years and it also registered this as a trademark in 2008. The suit as wel states that Active Network has been, "providing information regarding the programing of participatory sports and nonprofessional activities and diversion events; sports training services, videlicet, providing personal training schedules and programs … EA's use of Simon Marks containing the word 'hot' applied to online personalized fitness programs and services has and will continue to damage Active Network."
Exactly how the games are prejudicious this company's reputation or causing people to confuse Wii fitness titles for technology services isn't really whol that apparent.
Active Network wants EA to stop making, marketing, and selling any games with the word "Agile" in its championship, which seems a bit laughable. The lawsuit is besides requesting that EA ante up $75,000 in damages (addition attorney fees).
This sounds like a middling frivolous lawsuit, unworthy of actually being heard in a court. That decision, however, is adequate to the judge that hears the case, so we'll have to wait and insure what happens. That said, one tail end't say this story stupidly about a same case that surfaced live on year: Tim Langdell vs. EA (and the rest of the videogame community).
